Terms of Use

Culinary Earth Educational Foundation Inc
Effective September 22, 2026

These terms govern your use of culinaryearth.org and your participation in programs you register for through it. By using the site, you agree to them. If you don't, please don't use the site.

1. Who we are

Culinary Earth Educational Foundation Inc is a nonprofit corporation organized under the laws of the State of Indiana and a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code (EIN 33-2585981). We build and maintain community garden space, provide garden, culinary, and nutrition education, and share what the gardens produce with the people and programs around them.

2. About the information on this site

We try to keep the site accurate, but program descriptions, schedules, locations, and availability change. Nothing on this site guarantees that a program will run, run at a stated time, or have space available.

Nutrition and food information on this site and in our classes is general education, not medical or dietary advice. We are gardeners, cooks, and educators — not physicians, registered dietitians, or nutritionists. If you have a medical condition, an allergy, or a specific dietary need, talk to your doctor or dietitian.

3. Registering for programs

Free programs. Garden workdays and volunteer sessions are free. No fee applies.

Classes. Classes carry a registration fee of $10 to $40, shown on each class. The fee reserves your place in a scheduled session.

The registration fee is not a charitable donation. You receive instruction, materials, and in most cases a meal in exchange for it. It is not tax-deductible, and we do not issue donation receipts for it. If cost is a barrier, contact us — we don't turn people away over the fee.

Cancellations and refunds. If you cancel at least 48 hours before your session, we'll refund your fee or move you to another session, whichever you prefer. Within 48 hours we generally can't refund, because food and materials have been bought. If we cancel or reschedule a session for any reason, you get a full refund or a place in another session, your choice.

Registering someone under 18. A parent or legal guardian must complete the registration and, by doing so, confirms they have authority to enroll the child and to make the consent choices on the form. Participants under 18 must be accompanied by a parent or guardian.

4. Taking part in our programs

Our programs involve real gardening and real cooking: soil, tools, weather, sun, insects, heat, knives, and stoves. By participating, you accept the ordinary risks of these activities and agree to follow the safety instructions of our session leads and volunteers.

Food allergies and dietary restrictions. We prepare food with fresh produce in shared spaces with shared equipment. We cannot guarantee that any dish is free of any allergen, or free of cross-contact. You must tell us about allergies and dietary restrictions when you register. We will do our best to accommodate them and will tell you honestly when we can't.

These Terms are not a liability waiver and are not intended to be one. Before a first in-person session, each participant — or the parent or guardian of a minor participant — will be asked to sign a separate waiver and medical release. That document, not this page, governs the terms of participation.

5. Donations

Culinary Earth Educational Foundation Inc is a 501(c)(3) public charity, and donations are tax-deductible to the extent allowed by law. Nothing on this site is tax advice; consult your tax advisor about your own situation.

Donations are voluntary and, unless we've agreed otherwise with you in writing, unrestricted — we apply them to the general work of the organization. Suggested giving levels illustrate what gifts make possible; they are not a promise that a particular gift will be spent on a particular thing.

Monthly gifts continue until you cancel. You can cancel or change a monthly gift at any time using the link in your receipt, or by emailing us.

Donations are generally non-refundable. If something went wrong — a wrong amount, a duplicate, an unauthorized charge — contact us promptly and we will make it right.

We send a written acknowledgment for gifts of $250 or more, as the IRS requires. Please keep your receipts for your tax records.

6. Photographs and media

We photograph our programs. At public events and open garden workdays, you may appear in photographs we use on this site, in printed materials, in grant reports, and on social media. For classes and any program involving minors, photography is by consent, requested at registration; you may decline without affecting participation, and you can withdraw consent at any time by emailing us.

7. Using the site

Please don't use the site for anything unlawful; harass, threaten, or impersonate anyone; attempt to access the site or its systems without authorization; scrape or bulk-collect content or contact information; submit false information or register someone without their knowledge; or upload anything containing malicious code.

What you send us. You keep ownership of messages and submissions you send through the site. You give us permission to read and act on them and — if you clearly offered something for that purpose, such as a story or testimonial — to publish it with attribution. If you'd rather we didn't publish something, say so and we won't.

What's ours. The name Culinary Earth Educational Foundation, our logo, and the text, photographs, and design of this site belong to us or are used with permission. You're welcome to link to us and quote us with credit. Please ask before reproducing substantial portions of the site or using our name or logo in a way that suggests we endorse something.

8. Payments and other services

Payments are processed by Stripe, Inc., and when you pay you are also subject to Stripe's terms and privacy policy. We do not receive or store your full card number. The site may link to other websites we don't control; we aren't responsible for their content or privacy practices.

9. Disclaimers and limits

The website is provided "as is." We don't warrant that it will be uninterrupted, error-free, or free of harmful components, and we disclaim implied warranties to the extent the law allows. To the fullest extent permitted by Indiana law, Culinary Earth Educational Foundation Inc and its directors, officers, volunteers, and instructors will not be liable for indirect, incidental, or consequential damages arising from your use of this website, and our total liability arising from your use of the website will not exceed the amount you paid us through the site in the twelve months before the claim.

This section applies to the website only. It does not limit anything in a signed waiver, release, or program agreement, and it does not disclaim liability for gross negligence, willful misconduct, or anything else that cannot be disclaimed under Indiana law.

10. Governing law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws principles. Any dispute arising from them or from your use of this website will be brought in the state or federal courts located in Marion County, Indiana.

11. Changes

We may update these Terms. If we do, we'll change the effective date at the top and note material changes on the site. Continuing to use the site after a change means you accept the updated version.
